SENATE CONCURRENT RESOLUTION NO. 75

Requesting the Joint Committee on Government and Finance study requiring the arresting agency to pay certain costs of incarceration at regional jails.

Whereas, Municipalities, towns and villages within a county may have arrest powers and may arrest individuals who are subsequently placed in regional jails; and
Whereas, The cost per day for certain incarcerated inmates at regional jail facilities within the state is required to be paid by a county even when the county may not be the agency who arrested the individual subsequently placed in a regional jail; therefore, be it
Resolved by the Legislature of West Virginia:
That the Joint Committee on Government and Finance is hereby requested to study requiring the arresting agency to pay certain costs of incarceration at regional jails; and, be it
Further Resolved, That the Joint Committee on Government and Finance report to the regular session of the Legislature, 2005, on its findings, conclusions and recommendations, together with drafts of any legislation necessary to effectuate its recommendations; and, be it
Further Resolved, That the expenses necessary to conduct this study, to prepare a report and to draft necessary legislation be paid from legislative appropriations to the Joint Committee on Government and Finance.
